ClipCall Inc. (“we”, “us” or “Clipcall”“) respects your privacy and is committed to protecting the Personal Information (defined below) that users  ( “User” or “you”) share with us in connection with the use of our ClipCall mobile application (“App“), our website located at (the “Site”) and our online services (collectively with the App and the Site, the “Services”). This Privacy Policy (the “Policy”) is intended to outline our practices with respect to the Personal Information (as defined below) we may collect from Customers and Service Providers in connection with the Services, the ways we may use such information, and the rights available to you.

In addition to this Policy, please also review our Terms of Service, along with such other of our policies we may notify you of from time to time.

The definitions in our Terms of Service apply to this Policy unless stated otherwise.

This Policy does not apply to the practices of companies that we do not own or control, or to individuals whom we do not employ or manage, including any of the third parties to whom we may disclose information as set forth in this Privacy Policy.

The Services

The Services are designed to assist individuals seeking services (“Customers”) in connecting with local providers of goods and services (“Service Providers”). Except where specifically indicated herein, the Policy applies equally to Customers and Service Providers, both of whom are included in the definition of “User” and “you” above. In order to connect to Service Providers via the Services, Customers must disclose certain information, including their address, telephone number, the type of Service Provider they are looking for, and a description of the service needed, which are submitted using a video that the Customer filmed on his/her device within the App interface (a “Service Request”).

For Service Providers, the Services are designed to help you identify applicable leads and Customers that fit your profile. In order to receive Service Requests via the App, you must provide your business contact details including address, landline and mobile phone numbers, descriptions of your services and competitive advantages, and any other information reasonably requested about your business activities. The Services allow Customers to submit Service Requests, Services Providers to provide Quotes to potential Customers in response to Service Requests, enable communication between Customers and Service Providers via the App, and provide certain services to assist in fulfilling Service Requests, such as project tracking tools, identifying the location of Service Providers to facilitate service call planning, and payment facilitation.

What Information We Collect

We collect certain information that allows someone to identify or contact Customers and Service Providers, as applicable, including, for example, your name, address, telephone number, e-mail address (together with any other non-public information about you that is associated with or linked to any of the foregoing, “PII” or “Personal Information”). We also collect information that is not associated with or linked to your PII and that does not, by itself, permit the identification of an individual (“Non-Personal Information”). We collect PII and Non-Personal Information as follows:

Information You Provide To Us

If you, Service Provider, tell us where you are (e.g., by allowing your mobile device to send us your location), we may store and use that information only to provide you with the Services. Location services are an essential part of the Services – we use them to help provide estimated Service Provider arrival times to Customer, but we do not store this information following confirmation of arrival times (which are used as a metric in the Service Provider quality score). As set forth in the Terms, we require Service Providers to leave location services enabled in the App when using our Services.

If you provide us Feedback or contact us via e-mail, we will collect your name and e-mail address, as well as any other content included in the e-mail, in order to send you a reply.

When you post content through the App (such as messages to Service Providers and/or Customers) we will collect and store the information in that posting and the other party to your communications will be able to see such messages when sent and, as applicable, in connection with disputes arising between such parties related to the Services.

When you place or receive calls or send messages through the App, those calls are recorded and stored on our servers. When you create an Account we will collect all information necessary to complete transactions as applicable to your role (i.e. as Customer or Service Provider). For all Users, this information includes name, address, phone and email information, and the information required to process payments (which may be credit card, debit card, ACH, bank account, or as otherwise provided by you, collectively, “Payment Information”). In addition, for all Service Providers, we collect information required for us to fulfill our obligations with respect to reporting taxable income (i.e., 1099 forms, which is included in the definition of Payment Information). Some or all of the Payment Information may be shared with third parties who will help process payments for Projects, as further detailed in the “With whom we Share Information, and for what Purposes” section below. Payment Information is encrypted using industry standard technology.

We retain all information and communications related to Service Calls, Quotes, and Projects exchanged via the App, including emails, calls, images, videos, etc. 

We also collect other types of PII that you provide to us voluntarily.

We may also collect PII at other points in the Services that state that PII is being collected.

Information Collected via Technology

Information Collected by Our Servers. To make the Services more useful to you, our servers (which may be hosted by a third party service provider) collect information from you, including your browser type, operating system, Internet Protocol (“IP”) address (a number that is automatically assigned to your computer when you use the Internet, which may vary from session to session), domain name, and/or a date/time stamp for your visit.

Log Files.  As is true of most websites, we gather certain information automatically and store it in log files. This information includes IP addresses, browser type, Internet service provider (“ISP”), referring/exit pages, operating system, date/time stamp, and clickstream data.  We use this information to analyze trends, administer the Services, track Users’ movements around the Site, gather demographic information about our user base as a whole, and better tailor our Services to our Users’ needs.  For example, some of the information may be collected so that when you visit the Services again, you will be recognized and the information could then be used to serve information appropriate to your interests.  Except as noted in this Policy, we do not link this automatically-collected data to PII.

Cookies. Like many online services, we use cookies to collect information. “Cookies” are small pieces of information that a website sends to your computer’s hard drive while you are viewing the website.  We may use both session Cookies (which expire once you close your web browser) and persistent Cookies (which stay on your computer until you delete them) to provide you with a more personal and interactive experience on our Services.  This type of information is collected to make the Services more useful to you and to tailor the experience with us to meet your special interests and needs. 

Mobile Services. We may also collect Non-Personal Information from your mobile device if you have downloaded our App. This information is generally used to help us deliver the most relevant information to you. Examples of information that may be collected and used include your location, how you use the App, and the type of device you use. In addition, if our App crashes, we will receive information about your mobile device model software version and device carrier, which allows us to identify and fix bugs and otherwise improve the performance of our App. This information is sent to us as aggregated information and is not traceable to any individual and cannot be used to identify an individual.

Pixel Tags.  We use “Pixel Tags” (also referred to as clear Gifs, Web beacons, or Web bugs), which are tiny graphic images with a unique identifier, similar in function to Cookies, that are used to track online movements of Web users. In contrast to Cookies, which are stored on a user’s computer hard drive, Pixel Tags are embedded invisibly in Web pages. Pixel Tags also allow us to send email messages in a format Users can read, and they tell us whether emails have been opened to ensure that we are sending only messages that are of interest to our Users. We may use this information to reduce or eliminate messages sent to a User.  We do not tie the information gathered by Pixel Tags to our Users’ PII.

How We Respond to Do Not Track Signals.  We do not currently respond to “do not track” signals or other mechanisms that might enable consumers to opt out of tracking on our Services.

Analytics. Other companies may set their own cookies or similar tools when you visit our Site or use the Services. This includes third party analytics services such as Google Analytics (“Analytics Services”) that we engage to help analyze how users use the Services. We may receive reports based on these parties’ use of these tools on an individual or aggregate basis. We use the information we get from Analytics Services only to improve our Site and Services. The information generated by the Cookies or other technologies about your use of our Site and Services (the “Analytics Information”) is transmitted to the Analytics Services, which use Analytics Information to compile reports on user activity. The Analytics Services may also transfer information to third parties where required to do so by law, or where such third parties process Analytics Information on their behalf. Each Analytics Services’ ability to use and share Analytics Information is restricted by such Analytics Services’ Terms of Use and Privacy Policy. By using our Site and Services, you consent to the processing of data about you by Analytics Services in the manner and for the purposes set out above. Inviting Others to Join. You can invite others to join the Services by sending a download link generated via the Services via text, email, social media, etc. to such other individuals.

How we use the Information we Collect: In general, PII is used either to respond to requests you make or to help us serve you better.  We use your PII in the following ways:

To provide you with the Services and related functionality;

To improve the quality of the Services;

To respond to your inquiries, customer service and support requests, feedback or questions, and update you with information pertaining to your request;

To investigate and respond to claims that any content available through the Services violates the rights of third parties;

To enhance and personalize your experience and customize content we display through the Services, including advertisements served by third parties;

To resolve disputes and enforce our policies, including investigation of potential violations thereof;

To perform research, technical diagnostics, and analytics or for statistical purposes;

To provide you with the most relevant additional services and offers; and

To detect, prevent, or otherwise address fraud, security or technical issues.

We may also use your Personal Information to create Non-Personal Information records by excluding information that makes the information personally identifiable to you.

We use Non-Personal Information we collect to analyze trends, administer and improve the Services, track Users’ movements in the App, gather demographic information about our user base as a whole, and better tailor our Services to our Users’ needs. In addition, we reserve the right to use Non-Personal Information for any legitimate business purpose.

Feedback. If you provide Feedback to us, we may use and disclose such Feedback in accordance with our Terms, provided we do not associate such feedback with your Personal Information. We may publish Feedback from time to time, provided that we will obtain your consent prior to posting any Feedback that is associated with your Personal Information. We will handle any Personal Information incorporated into Feedback in accordance with this Policy, provided that we may contact you regarding such Feedback.

With whom we Share the Information, and for what Purposes

Projects. We share the information included in Service Requests, including the video, with Service Providers, to allow the Service Providers to connect with Customers via the App and otherwise use the App to review and respond to Service Requests. We will share certain Service Provider information with Customers when a Service Provider responds to a Service Request, such as the Service Provider’s business profile and Quote information.  In connection with individual Projects, we will share information between Customers and Services Providers relating to such Project, such as Quotes, invoices, project documents and other information needed to facilitate the performance of the Project.

Call Records and User Generated Content (including the video of the Service Request and Chats). The relevant Service Providers, Customer and ClipCall may access calls, chats and videos made via the App in connection with the applicable Project and, in ClipCall’s case, to provide and improve the Services. Service Request videos or photos may be shared on various social networks published by ClipCall to locate Service Providers.

Third Party Services. We might share your information with our business partners for performing services for us, such as payment processing, customer service, technical support, tracking, marketing assistance, serving ads and ad tracking, and analytics. Third Party Services we use include:

Security of Credit Card, Debit Card and Bank Account Information. For online payments and/or Automated Clearing House (ACH) payouts, we use the payment services of Stripe ( We do not process, record or maintain your credit card or bank account information. Other Disclosures. We may share your information, including PII, if we are required by law enforcement or other governmental agency; in response to a subpoena, warrant or an investigative demand, a court order, or with respect to any legal process; in order to enforce our intellectual property rights or other legal rights or to defend against legal claims; if we believe it is necessary to investigate, prevent, or take action regarding illegal activities, suspected fraud or other wrongdoing, safety of people or property, violations of our policies, to enforce our policies, or as otherwise required in order to comply with the applicable laws and regulations. In such circumstances, we may raise or waive any legal objection or right available to us.

Affiliates and Corporate Transaction. We may share Information, including PII, (i) with our parent company, any subsidiaries, joint ventures, or other companies under a common control (collectively “Affiliates“),  (ii) in the event of a corporate transaction (e.g. sale of a substantial part of our business, merger, consolidation or asset sale), and (iii) with third parties with whom we jointly offer products and services, or with whom we offer co-branded products and services (“Branding Partners”). In any of the situations in this paragraph, our Affiliate or acquiring company or Branding Partner, as the case may be, will assume the rights and obligations described in this Policy.  Also, in each such situation, the rights in this Policy set out under  How we use the Information we Collect” also will extend to the products and services of our Affiliate or acquiring company or Branding Partner, as the case may be.

Non-Personal Information. Non-Personal Information may be shared with third parties (including ad networks, advertising companies and service providers) in any of the above circumstances, as well as for the purpose of developing or delivering tailored or targeted advertising (whether via our Site or App, or websites or applications of third parties), or for the purpose of improving our Service, conducting business analysis or other business purposes. This information may be combined with information we collect from other sources, to the extent that the information remains Non-Personal Information.

Your Choices Regarding your Information

App. You can stop all collection of information by the App by uninstalling the App. Doing so will prevent you from being able to use the Services.

Email and Text Messages. We will communicate with you primarily in the form of emails and text messages. You can opt out of receiving these communications by clicking the “Unsubscribe/Remove” link at the bottom of each email or text message. Please note that even if you unsubscribe or opt-out, we may still send you Services-related communications (e.g., emails and text messages related to your account).

Cookies. If you decide at any time that you no longer wish to accept Cookies from our Services for any of the purposes described above, then you can instruct your browser, by changing its settings, to stop accepting Cookies or to prompt you before accepting a Cookie from the websites you visit. Consult your browser’s technical information for details on how to do this. If you do not accept Cookies, however, you may not be able to use all portions of the Services or all functionality of the Services.

Changing or Deleting Your Personal Information. You should review, change, update or correct the Personal Information in your account by logging into your account or contacting us. We are dependent on your information and it is your responsibility to keep your PII updated and accurate for so long as you use the Services. You authorize us to use and disclose any new or modified information that you provide in accordance with this Policy, and you agree that we are under no obligation to delete or modify information that you have previously chosen to provide us. If you completely want to delete all of your Personal Information, then your Account will become deactivated, although any content associated with your Account will remain on the Services unless we have deleted them. We may also retain an archived copy of your records as required by law or for legitimate business purposes. To delete your account please contact us at: Please remember, however, if we have already disclosed some of your Personal Information to third parties, we cannot access that Personal Information any longer and cannot force the deletion or modification of any such information by the parties who had access to your Personal Information through the Services. Certain information is necessary in order for us to provide the Services; therefore, if you delete such necessary information you may not be able to use the Services. Please note that even though you may request the deletion of your Personal Information by us, we may be required (by law or otherwise, such as to prevent fraud, resolve disputes, troubleshoot problems, or to enforce the Terms) to keep this information (or to keep this information for a certain time) in which case we will comply with your deletion request only after we have fulfilled such requirements. When we delete Personal Information, it will be deleted from the active database, but may remain in our archives. 

Information about Children

Our Services are not intended for children under the age of 18, and we will not knowingly collect Personal Information from children. If we become aware that a User is under the age of 18, we will attempt to remove their Personal Information from our records as soon as possible. If you believe that we might have any Personal Information from a child under 18, please contact us.

A Note to Users Outside of the United States

If you are a non U.S. User of the Services, by using the Services and providing us with information, you acknowledge and agree that your PII may be processed for the purposes identified in this Policy.  In addition, your PII may be processed in the country in which it was collected and in other countries, including the United States, where laws regarding processing of PII may be less stringent than the laws in your country.  By providing your information, you consent to such transfer.

Information Disclosed to Third Parties

This Policy addresses only our use and disclosure of information we collect from and/or about you via the Services. If you disclose information to others, or authorize us to do the same under this Policy, the use and disclosure restrictions contained in this Policy will not apply to any third party. We do not control the privacy policies of third parties, and you are subject to the privacy policies of those third parties where applicable.

The Services may contain content or links to other websites that are not owned or controlled by us. We have no control over, do not review, and are not responsible for the privacy policies of or content displayed on such other websites. When you click on such a link, you will leave our Services and go to another site. During this process, another entity may collect Personal Information or Non-Personal Information from you. Please review the privacy policy of any new site you visit.

Direct Marketing

We may share your email address and phone number with our marketing partners for their direct marketing purposes. However, we will not disclose your PII with such partners unless you have opted in by following the instructions we provide to allow such disclosure. You can decline receiving email offers from us or our affiliates and partners by sending a blank message with the word “Remove” in the subject area to We may still send you operational information about the Services (i.e., account updates) to the contact information indicated in your account.

If you unsubscribe we will remove your email address from our marketing distribution lists and from any future lists. However, you may need to separately unsubscribe from marketing offers sent by our marketing partners who already have your information prior to our receipt of your removal request.

Updates or Amendments to the Privacy Policy

This Policy is subject to occasional revision, and if we make any material changes in the way we use your Personal Data, we will notify you via a pop-up notice in the App or by sending you an e-mail to the last e-mail address you provided to us and/or by prominently posting notice of the changes on our Site. Any changes to this Policy will be effective thirty (30) calendar days following our posting of notice of the changes within the App and on our Site. These changes will be effective immediately for new Users of our Service. Continued use of our Site or Service following notice of such changes will indicate your acknowledgment of such changes and agreement to be bound by the terms and conditions of such changes.
